This e-Advisory is simply to serve as a reminder that the “sunrise” period
for obtaining a “.eu” domain name commences on December 7, 2005. Generally,
a “.eu” domain name is available only to (a) individuals who are residents
in the European Union, (b) entities/undertakings established in the European
Union, or (c) entities/undertakings having their registered office, central
administration, or principal place of business within the European Union. A
United States based owner of a trademark registered in one of the countries
in the European Union may apply for a “.eu” domain name, however, through a
designated licensee
within the European Union .
The “sunrise”
period allows for early application for a domain name
that correspond to a party’s registered mark. For United States based
owners, it appears that only the first phase of the “sunrise” period will
allow them to obtain a “.eu” domain name. Phase 1 runs from December 7,
2005 to February 6, 2006 (however, given the “first come first served”
nature of the system, it is best to apply as early as possible). In order
to qualify, the United States based owner must have a supporting trademark
registration in any of the European Union member countries or a Community
Trademark (CTM) registration, and grant a license to a party domiciled in
the European Union. The “.eu” application also must be filed through an
appropriate Registrar ,
who may also be the licensee .

particular European Union country in order to establish a European based
registration for purposes of applying for a “.eu” domain name during the
